One of the questions I’m often asked is “how long does it take to file a Chapter 13 Bankruptcy?”
Well, as a practicing Bankruptcy attorney, I can tell you that I can move as fast as you can!
Now, this is a three-visit process. It’s one, two, three.
First visit: you come in to meet with me. I paint the picture.
Second visit: you bring back all the paperwork required to file your case.
And by the way, for the paperwork requirement, you’ll be given a check list that will include things like the last three years’ tax returns, your pay stubs for the last six months, for both you and your spouse (if you have a spouse, whether they file or not), car titles, the mortgage for your house…
The checklist is very exhaustive, it’s a tedious endeavor to undertake, as no one really has all the things required on the checklist at their fingertips.
However, they are all necessary to get your case filed.
So when you come into my office and meet with me, (and again, there’s no fee for the initial consultation) together, we’ll create a plan of action to help you file your case. But again, I can move as quickly as you can in the one two three process.
The first visit consultation, the second visit I review your paperwork with you, and the third visit you make your final payment, and sign your final paperwork. This can literally be done in 2 days, or more. That depends on how fast you can get your paperwork done.
Obviously, I believe it’s going to take more than one day to do it, because I think you’d be putting too much pressure on yourself in the situation, to do it all at once.
So, take the pressure off when you get this list from me, and don’t think you’re going to do it in one day!
